ZIIZ.IN is a property marketplace platform that enables users to browse, search, list, buy, sell, and rent residential and commercial properties across India. We connect property owners, renters, buyers, and agents through our online marketplace.

By accessing or using our Website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these Terms, you may not access or use our Website and services. We reserve the right to update, modify, or change these Terms at any time. Continued use of the Website after changes constitutes your acceptance of the updated Terms.

2. Definitions

For purposes of these Terms of Use, the following terms shall have the meanings set forth below:

“User” or “You” means any individual or entity that accesses or uses the Website, including but not limited to property owners, property renters, prospective buyers, prospective renters, agents, and visitors.

“Publisher” means a User who lists a property on our Platform.

“Enquirer” means a User who expresses interest in or makes inquiries about a property listed on our Platform.

“Property” means any residential or commercial real estate listed on our Platform, including details such as description, images, price, and location information.

“Listing” means a property advertisement posted by a Publisher on the Platform.

“Content” means all text, images, videos, data, information, and other materials posted or uploaded by Users or displayed on the Platform.

“Premium Features” means additional services and customization options available for a fee, including featured listings and custom promotional plans.

“Admin” means Ziiz India Technologies’ administrative staff responsible for approving, moderating, and managing content on the Platform.

“We,” “Us,” “Our,” or “Company” means Ziiz India Technologies, located at Tezcher Building, Kalamassery, Kochi, India.

3. Access and Use of the Website

3.1 Website Browsing

Guests and visitors can browse property listings on our Website without creating an account or providing personal information. No registration is required to search or view properties.

3.2 Contact and Inquiry

To express interest in a property or make inquiries, users are required to provide the following mandatory information:

  • Full Name
  • Email Address
  • Phone Number
  • WhatsApp Number

All information provided must be accurate and current. Users are responsible for maintaining the confidentiality of their contact information.

3.3 Property Listing

Publishers (Users who list properties) are not required to register for an account. To list a property on our Platform, Publishers must provide:

  • Full Name (Mandatory)
  • Email Address (Mandatory)
  • Phone Number (Mandatory)
  • WhatsApp Number (Mandatory)
  • Property Details and Information
  • Property Images and Descriptions

By submitting a property listing, you represent and warrant that all information provided is accurate, truthful, and complete to the best of your knowledge.

3.4 Listing Approval Process

All property listings submitted to our Platform are subject to administrative review and approval before publication. Admin approval typically occurs within 1 hour to 48 hours from the time of submission. During this period, we review listings to ensure compliance with these Terms and our content guidelines.

We reserve the right to reject, modify, or request additional information for any listing without providing reasons for rejection. Once approved, your listing will be published on the Platform and visible to all users.

3.5 Direct Communication Between Users

Enquirers may contact Publishers directly regarding properties listed on our Platform. There are no restrictions or limitations on direct communication between Publishers and Enquirers. Users communicate “at their own risk,” and we assume no responsibility for communications, agreements, or transactions conducted outside our Platform.

4. Property Listing Policies

4.1 No Registration Required for Listing

Unlike many platforms, ZIIZ.IN does not require users to create accounts or register to list properties. You may submit property listings directly by providing the mandatory contact information specified in Section 3.3.

4.2 Unlimited Free Listings

ZIIZ.IN provides unlimited free property listings to all Publishers. There are no charges or fees for listing properties on our Platform. Publishers can list as many properties as they wish without any cost or restriction.

4.3 Current Listing Limitations

At present, there are no restrictions on the number of properties any individual Publisher can list. However, we reserve the right to establish listing limitations in the future at our sole discretion. If such limitations are implemented, we will provide notice to Publishers.

4.4 Premium Features and Custom Plans

While basic property listings are free, ZIIZ.IN offers optional Premium Features and Custom Promotional Plans for Publishers seeking enhanced visibility and marketing opportunities. Premium Features may include:

  • Featured/highlighted listings
  • Priority placement in search results
  • Custom promotional packages
  • Extended listing duration
  • Additional support and services

Premium Features and Custom Plans are tailored to individual user preferences and requirements. Pricing, availability, and specific features vary based on the Publisher’s needs. Custom plans are developed collaboratively and are fully dependent upon your specific use case and preferences.

4.5 No Commission or Transaction Fees

ZIIZ.IN does not charge any commission, transaction fees, or payments for property sales, rentals, or any transactions conducted through our Platform or as a result of listings on our Website. Our service is completely free of transaction-related charges.

5. User Responsibilities and Code of Conduct

5.1 Accurate and Truthful Information

All Users agree to provide accurate, truthful, and complete information when submitting listings, making inquiries, or contacting other Users. Users are solely responsible for the accuracy and authenticity of all information they provide.

5.2 Prohibited Conduct

Users agree not to engage in any of the following prohibited activities on our Platform:

  • Fraudulent Activity: Submitting false, misleading, or fraudulent property information or using deceptive practices to attract inquiries
  • Spam and Abuse: Sending unsolicited messages, spamming other Users, or abusing the platform’s communication features
  • Harassment and Threats: Harassing, threatening, abusing, defaming, or intimidating other Users
  • Illegal Content: Posting content that violates Indian laws or promotes illegal activities
  • Copyright Violation: Uploading copyrighted images, videos, or content without proper authorization or attribution
  • Fake Listings: Creating fictitious or misleading property listings
  • Identity Fraud: Impersonating another person or entity
  • Hacking or Unauthorized Access: Attempting to gain unauthorized access to our Platform, systems, or User data
  • Manipulation: Manipulating prices, offering, or bidding information to deceive other Users
  • Explicit or Offensive Content: Posting sexually explicit, obscene, or highly offensive content
  • Promotion of Violence: Encouraging, promoting, or glorifying violence or harm
  • Personal Information Misuse: Using other Users’ personal information without consent
  • Terms Violation: Violating any other terms or policies outlined in these Terms of Use

5.3 Fact Verification for Suspicious Listings

If ZIIZ.IN staff members have concerns regarding the accuracy or authenticity of a property listing, we will directly contact the Publisher via phone call to inquire about and verify the facts presented in the listing. This is our primary method of addressing potential factual inaccuracies or suspicious content.

6. Content Ownership and Intellectual Property

6.1 User-Generated Content

Users retain ownership of content they create and upload to our Platform, including property descriptions, images, and videos. However, by uploading content to ZIIZ.IN, Users grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, display, and distribute the content for the purposes of operating our Platform and providing services.

6.2 Platform Content

All content on our Platform not created by Users, including but not limited to our logos, designs, functionality, text, and graphics, are the exclusive property of Ziiz India Technologies and protected by copyright and intellectual property laws. Users may not reproduce, modify, or distribute this content without our express written permission.

6.3 Copyright Compliance

Users agree not to violate copyright, trademark, or other intellectual property rights of third parties. If you believe your intellectual property rights have been violated on our Platform, please contact us immediately at [email protected].

7. Property Authenticity and Verification

7.1 No Guarantee of Authenticity

ZIIZ.IN does not provide a 100% guarantee regarding the authenticity, accuracy, or truthfulness of property information listed on our Platform. While we make reasonable efforts to verify listings through direct inquiry with Publishers when concerns arise, we cannot guarantee that all properties listed are genuine or that all information is accurate.

7.2 Best Efforts Verification

We implement reasonable measures to verify property listings, including:

  • Reviewing submitted information for obvious inconsistencies
  • Contacting Publishers to verify facts when concerns are identified
  • Monitoring for duplicate or suspicious listings
  • Removing clearly fraudulent content when identified

However, ZIIZ.IN assumes no responsibility for verifying the authenticity of properties, prices, or any information provided by Publishers.

7.3 User Responsibility

Users (particularly Enquirers) are responsible for independently verifying property information, conducting property inspections, and performing due diligence before making any decisions or commitments. We strongly recommend:

  • Visiting properties in person before making decisions
  • Requesting documentation and verifications from Publishers
  • Consulting with qualified professionals (architects, surveyors, lawyers)
  • Conducting independent background checks on Publishers
  • Using legal counsel for property transactions

8. User Removal and Termination of Access

8.1 Admin Discretion

ZIIZ.IN reserves the absolute and sole discretion to remove Users, delete listings, or terminate access to our Platform at any time, with or without warning, for any reason or no reason at all. We may take such action if:

  • A User violates these Terms of Use
  • A User engages in prohibited conduct
  • We receive complaints about a User
  • We determine that a listing or User poses a risk to our Platform
  • We believe action is necessary to protect our Platform or other Users

8.2 Suspension and Permanent Removal

Upon violation of these Terms, we may temporarily suspend or permanently remove a User’s account and listings without notice. We are not obligated to provide reasons for such removal or to offer the User an opportunity to remedy the violation.

8.3 Data Deletion

When a User is removed or terminated, associated listings and publicly visible information may be deleted from our Platform. However, certain data may be retained in compliance with legal obligations or for administrative purposes.

9. Limitation of Liability and Disclaimers

9.1 No Responsibility for User Disputes

ZIIZ.IN assumes no responsibility, liability, or obligation regarding disputes, conflicts, or issues between Users (Publishers and Enquirers). Any disagreements, misunderstandings, or conflicts arising from property inquiries, communications, or transactions are entirely the responsibility of the involved Users.

We are not involved in any disputes between Publishers and Enquirers, and we will not mediate, arbitrate, or intervene in such matters. The relationship and responsibility for dispute resolution rest entirely with the Publishers and Enquirers involved.

9.2 No Guarantee of Communication Success

While our Platform facilitates communication between Users, we provide no guarantee that communications will be successful, timely, or result in desired outcomes. We assume no responsibility for failed communications, misunderstandings, or broken connections between Users.

9.3 “AS IS” Disclaimer

Our Platform and all services are provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, representations, or guarantees regarding:

  • The accuracy, completeness, or reliability of any information on our Platform
  • The quality, functionality, or performance of our Website
  • The suitability of our Platform for your specific needs or purposes
  • The results you may obtain from using our Platform
  • The uninterrupted or error-free operation of our Website

9.4 No Property Guarantees

ZIIZ.IN provides no guarantees, warranties, or assurances regarding:

  • Property authenticity or legality
  • Property ownership or title
  • Property condition or compliance with laws
  • Property prices or market value
  • Availability of properties at listed prices
  • Any aspect of properties listed on our Platform

9.5 Limited Liability

To the maximum extent permitted by law, ZIIZ.IN shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from:

  • Your use or inability to use our Platform
  • Any property listing or information on our Platform
  • Any communication or transaction between Users
  • Errors, omissions, or inaccuracies in content
  • Loss of data, profits, or business
  • Interruption of services

This limitation applies even if we have been advised of the possibility of such damages.

10. Service Availability and Modifications

10.1 Right to Modify Services

We reserve the right to modify, suspend, or discontinue any feature, functionality, or service on our Platform at any time, with or without notice. Changes may be made for any reason, including but not limited to technical maintenance, business decisions, or legal compliance.

10.2 No Guarantee of Availability

11. User-to-User Transactions

Any agreements, transactions, or contracts between Publishers and Enquirers are entirely independent of ZIIZ.IN and do not involve our participation. We are not a party to any user-to-user transactions or agreements.

11.2 No Involvement in Disputes

If disputes arise from transactions between Users:

  • ZIIZ.IN is not responsible for mediating or resolving such disputes
  • Users must resolve disputes independently, directly, or through legal channels
  • We provide no dispute resolution services or mechanisms
  • We assume no liability for losses or damages resulting from user disputes

11.3 Direct Communication

Users communicate and conduct transactions at their own risk. ZIIZ.IN assumes no responsibility for:

  • Misrepresentations by other Users
  • Non-compliance with agreements
  • Fraud or deception by other Users
  • Payment or financial issues
  • Legal compliance of transactions
  • Enforcement of user-to-user agreements

12. Indemnification

By using our Platform, Users agree to indemnify, defend, and hold harmless Ziiz India Technologies, its officers, directors, employees, agents, and affiliates from and against any and all claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from:

  • Your violation of these Terms of Use
  • Your use of our Platform
  • Your property listings or content
  • Your violation of any law or third-party rights
  • Your disputes or transactions with other Users
  • Any claim arising from your conduct on our Platform

13. Confidentiality and Data Protection

Users acknowledge that information provided on our Platform may include contact details, property information, and other personal data. Users agree to:

  • Keep other Users’ contact information confidential and use it only for the stated purpose of property inquiry
  • Not sell, share, or distribute other Users’ personal information
  • Comply with all applicable data protection laws

14. Governing Law and Jurisdiction

15. Severability

If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms of Use, together with our Privacy Policy and any other policies posted on our Platform, constitute the entire agreement between you and ZIIZ.IN regarding your use of our Website and supersede all prior agreements and understandings.
