This DMCA and Copyright Policy (“Policy”) outlines Ziiz India Technologies’ (“ZIIZ.IN,” “we,” “our,” or “us”) commitment to protecting intellectual property rights and addressing copyright infringement on our property marketplace platform at https://ziiz.in/ (the “Website”).
ZIIZ.IN respects the intellectual property rights of others and expects all Publishers (users who list properties) to do the same. This Policy explains how we handle copyright infringement claims, takedown notices, and our procedures for addressing unauthorized use of copyrighted content on our Platform.
2. Copyright and Intellectual Property Rights
2.1 Our Content
All content on ZIIZ.IN not created by Users, including but not limited to our logos, designs, functionality, website layout, text, graphics, and other materials, are the exclusive property of Ziiz India Technologies and protected by copyright and intellectual property laws. Unauthorized use, reproduction, or distribution of this content is prohibited.
2.2 User-Generated Content
Users (particularly Publishers) who list properties on our Platform retain ownership of content they create, including property descriptions, original photographs, and other original materials. However, by uploading content to ZIIZ.IN, Users grant us a worldwide, royalty-free, non-exclusive license to display and distribute the content for Platform operations.
2.3 Publisher Responsibility
Publishers are solely responsible for ensuring that all content they upload to ZIIZ.IN (including property photos, descriptions, images, and other materials) does not infringe upon the copyright, trademark, or other intellectual property rights of third parties.
Publishers must own or have permission to use all content they submit. ZIIZ.IN does not verify copyright ownership or obtain permissions on behalf of Publishers.
3. Copyright Policy
3.1 Prohibited Conduct
Publishers agree not to:
- Upload copyrighted images, videos, or content owned by third parties without proper authorization or attribution
- Use property photos downloaded from other websites, stock photo sites, or other sources without permission
- Copy property descriptions, listings, or other content from competing platforms or websites
- Infringe on any copyrighted, trademarked, or otherwise protected intellectual property
- Violate any copyright laws, including but not limited to applicable Indian copyright laws
- Create fake or duplicate listings using images or content from other sources
3.2 Copyright Liability
ZIIZ.IN assumes NO copyright liability or responsibility for user-generated content published on our Platform. Publishers assume 100% liability for all content they upload, including copyright compliance.
If a Publisher uses copyrighted content without authorization, the Publisher alone is liable for copyright infringement, not ZIIZ.IN or its parent company Ziiz India Technologies.
3.3 Publisher Licensing Requirement
Publishers represent and warrant that they have the right to publish and display property listings on ZIIZ.IN, including all accompanying images, descriptions, and materials. Publishers must either:
- Own the copyright to all content they upload, or
- Have received proper written authorization from the copyright owner to publish the content on ZIIZ.IN
4. DMCA Takedown Notice Procedures
4.1 Copyright Complaint and Notification
If you believe your copyrighted work has been infringed upon or reproduced without authorization on ZIIZ.IN, you may submit a copyright complaint or DMCA takedown notice to our Copyright Agent.

4.3 Required Information for DMCA Takedown Notice
To be effective, a DMCA takedown notice must include the following information:
a) Your Information:
- Your full legal name
- Your address (physical or email)
- Your phone number
- Your email address
b) Copyright Work Identification:
- A clear description of the copyrighted work(s) that you believe are being infringed
- If multiple works are involved, provide a representative list
- For photographs: describe the specific image(s) and provide details about when and where they were created
c) Infringing Material Location:
- The specific URL or location on ZIIZ.IN where the infringing content is located
- A detailed description of where on the page the infringing material appears
- The Publisher’s name or account identifier associated with the infringing content (if known)
d) Your Authority:
- A statement that you are the copyright owner or are authorized to act on behalf of the copyright owner
- Your contact information for follow-up communication
e) Statement Under Penalty of Perjury:
- A statement that “I have a good faith belief that the use of the described material is not authorized by the copyright owner, its agent, or the law”
- A statement that “I am swearing under penalty of perjury that the information in this notice is accurate”
- Your digital or physical signature
f) Contact Information for Copyright Owner:
- If you are acting as an agent, provide the copyright owner’s contact information
4.4 Incomplete Notices
DMCA takedown notices that do not include all required information listed in Section 4.3 may be rejected or delayed. Incomplete notices reduce our ability to quickly address copyright infringement.
5. DMCA Takedown Response Procedures
5.1 Processing Timeline
Upon receipt of a valid DMCA takedown notice, ZIIZ.IN will respond within 24 hours and take the following action:
5.2 Immediate Content Removal
Once a DMCA takedown notice is received and verified, ZIIZ.IN will immediately remove the infringing content from the Platform. We do not wait for investigation, Publisher response, or counter-notice before removing content.
The content will be taken down as quickly as possible, typically within 24 hours of notice receipt.
5.3 No Investigation Period
ZIIZ.IN does not conduct a preliminary investigation or wait for Publisher explanation before removing content. Upon receipt of a valid DMCA notice, content removal is automatic and immediate.
5.4 Publisher Notification
When content is removed due to a DMCA takedown notice, the Publisher will be notified of:
- The removal of their listing or content
- The reason for removal (copyright infringement claim)
- The copyright owner’s contact information (if provided in the notice)
- The effective date of removal
5.5 Publisher Contact Information to Copyright Claimant
When a DMCA notice is received, we will provide the copyright claimant with the Publisher’s contact information (email, phone number) so they can communicate directly regarding the copyright dispute or potential resolution.
5.6 No Counter-Notice Process
ZIIZ.IN does not accept or process counter-notices from Publishers. We deal only with genuine cases as quickly as possible. Once content is removed based on a DMCA notice, it will not be restored.
If a Publisher disputes a takedown, they must work directly with the copyright claimant to reach resolution independently. ZIIZ.IN will not mediate disputes or restore content once removed.
6. Repeat Infringement and Account Termination
6.1 Zero-Tolerance Policy
ZIIZ.IN implements a zero-tolerance policy for repeat copyright infringement. We do not issue warnings or opportunities to cure violations for repeated copyright violations.
6.2 First Violation
If a Publisher’s content is removed due to a valid DMCA takedown notice:
- The Publisher is notified of the removal
- The Publisher’s account remains active
- Future compliance is expected
6.3 Repeat or Subsequent Violations
Upon any repeat or subsequent copyright infringement by the same Publisher:
- The Publisher’s account will be immediately and permanently terminated without warning
- All listings associated with the Publisher will be permanently deleted
- The Publisher will be permanently banned from the Platform
- The Publisher will not be eligible for re-registration or account restoration
6.4 Multiple Violation Threshold
There is NO multi-violation threshold. A single repeat offense results in permanent account termination and permanent ban.
6.5 Permanent Ban
Publishers who are permanently banned:
- Cannot create new accounts
- Cannot use alternative email addresses or contact information
- Cannot regain access to the Platform
- Cannot retrieve previously published listings or data
7. Copyright Monitoring and Enforcement
7.1 Periodic Copyright Monitoring
ZIIZ.IN commits to monitoring the Platform for copyright infringement, including:
- Duplicate or fake property images
- Content copied from other real estate platforms or websites
- Unauthorized use of third-party photographs or materials
- Listings using content from external sources without permission
7.2 Monitoring Frequency
While we do not monitor every listing every day, we conduct copyright monitoring checks periodically and increasingly as our capacity grows. Our monitoring should occur every day ideally, though resources and capacity may affect frequency.
7.3 Proactive Takedowns
If ZIIZ.IN identifies potential copyright infringement during our monitoring:
- The infringing content will be removed from the Platform
- The Publisher will be notified
- The same penalties for copyright violations will apply
8. Copyright Claim Investigation and Evidence
8.1 Verification of Takedown Notice
While we remove content immediately upon DMCA notice, we will verify that the notice includes:
- Legitimate contact information
- Clear identification of copyrighted work(s)
- Specific location of infringing material
- Valid statement under penalty of perjury
8.2 Obvious Copyright Claims
For obvious copyright infringement (such as entire property listings copied from other websites, or clearly unauthorized use of stock photography), ZIIZ.IN may remove content proactively without waiting for a formal DMCA notice.
9. Copyright Holder Remedies
9.1 Direct Resolution
Copyright owners are encouraged to contact the Publisher directly using contact information provided by ZIIZ.IN to work toward resolution, including:
- Requesting content removal (we will assist with this)
- Negotiating compensation or licensing agreements
- Resolving disputes independently
9.2 Enforcement Action
Copyright owners may take independent legal action against Publishers for copyright infringement. ZIIZ.IN cooperates with law enforcement and copyright holders but does not serve as a mediator or arbitrator in copyright disputes.
10. Publisher Indemnification
By listing a property on ZIIZ.IN, Publishers agree to indemnify, defend, and hold harmless Ziiz India Technologies from any copyright infringement claims, damages, costs, or legal expenses arising from:
- Content uploaded by the Publisher
- Copyright violations by the Publisher
- Unauthorized use of third-party intellectual property
- Any claims arising from the Publisher’s violation of copyright laws
11. Third-Party Content Responsibility
ZIIZ.IN assumes no responsibility for:
- Verifying copyright ownership
- Investigating copyright claims
- Ensuring Publisher compliance with copyright laws
- Damages resulting from copyright infringement by Publishers
- Legal disputes between copyright owners and Publishers
All responsibility for copyright compliance rests entirely with the Publisher.
12. Copyright Resources and Guidance
12.1 Publisher Education
ZIIZ.IN recommends that Publishers:
- Use only original property photographs they have taken themselves
- Obtain written permission before using any third-party photography or content
- Purchase licenses for any stock photos used in property listings
- Respect the copyright and intellectual property rights of others
- Understand copyright laws and fair use principles
12.2 Copyright Information
For more information about copyright law in India, Publishers may consult:
- Indian Copyright Act, 1957
- Official copyright office resources
- Legal counsel specializing in intellectual property
- Copyright education organizations
13. Safe Harbor
While ZIIZ.IN does not actively monitor all user content, we are committed to responding promptly to valid DMCA takedown notices and removing infringing content. Our immediate takedown policy upon receipt of a valid notice is intended to comply with legal safe harbor provisions.
14. Disputes and Disagreements
14.1 Our Decision Is Final
ZIIZ.IN’s decisions regarding copyright violations, content removal, and account termination are final and binding. We do not engage in disputes about copyright decisions or offer appeals.
14.2 No Mediation or Arbitration
ZIIZ.IN does not mediate copyright disputes between Publishers and copyright owners. Both parties must resolve such disputes independently or through legal channels.
15. Governing Law and Jurisdiction
This DMCA and Copyright Policy is governed by the laws of India, including the Indian Copyright Act, 1957, and any amendments thereto. DMCA is a U.S. law; however, this Policy applies equivalent principles to protect copyright under Indian law.
Any disputes related to copyright claims shall be subject to the exclusive jurisdiction of courts located in Kochi, Kerala, India.
